1. Scope and seller identity

These terms apply to physical goods offered through Findit. The Listing must identify the seller, contact details and whether the seller is a trader, private seller or Findit. Consumer protections may differ for a private sale, but the seller may not misrepresent trader status to avoid legal duties.

2. Listing information

The seller must accurately describe condition, quantity, dimensions, material features, defects, compatibility, origin where relevant, total price, delivery or pickup and return rules. Used, refurbished, personalised and digital-element products must be clearly identified.

3. Product safety and traceability

A trader must supply the manufacturer, responsible economic operator, product identifier, image and warnings required for an online offer. Only safe products may be listed. Findit may prevent publication where mandatory traceability information is missing and may check Safety Gate or authority data.

4. Recalls and unsafe products

Sellers must immediately notify Findit of a dangerous or recalled product and cooperate with removal, warnings, refunds, repairs and authority requests. Findit may disable offers, prevent reappearance and contact purchasers where required. A recall remedy does not depend solely on the seller's voluntary return policy.

5. Price, fees and invoices

The total payable price, delivery and any Platform fee must be displayed before order. The Listing and checkout identify the sales-document issuer. A private seller must not issue a business invoice unless legally entitled; a trader remains responsible for tax and invoicing duties allocated to it.

6. Order formation and payment

The interface states whether an order is an offer, reservation or accepted contract. Online payment is available only when checkout identifies the provider and status. Findit does not guarantee the seller's title to goods merely by facilitating payment.

7. Delivery, pickup, title and risk

The seller must state the delivery method, cost, estimated period and geographic restrictions. Statutory rules determine transfer of risk to a consumer; a seller term may not shift risk earlier where prohibited. Pickup parties should inspect identity and condition without exposing themselves to unsafe locations.

8. Consumer withdrawal

A consumer buying at distance from a trader generally has the statutory withdrawal right described in the Withdrawal Policy, subject to exceptions. The trader must provide return instructions and may make only lawful deductions. The right normally does not apply to a purely private sale.

9. Conformity and guarantees

A trader is responsible for statutory conformity. Depending on the facts, the consumer may request repair or replacement and later price reduction or termination under applicable law. A commercial guarantee is additional and must identify guarantor, scope, duration and process; it cannot replace statutory rights.

10. Returns and refunds

Returns should use a trackable method appropriate to the item. The responsible party must document receipt, inspection, deductions and refund. Dangerous goods, batteries, large items and hygiene products require lawful and safe instructions; a seller may not demand unlawful disposal as a condition of refund.

11. Prohibited goods and intellectual property

Counterfeit, stolen, unsafe, recalled or otherwise prohibited items may not be offered. The seller must own the item or be authorised to sell it and must have rights to images and descriptions. Findit may act on rights-holder and safety notices.

12. Reviews, disputes and Platform role

Reviews must reflect genuine experience and follow the Reviews Policy. Transaction disputes should include the Listing snapshot, communications, payment, dispatch and condition evidence. Unless Findit is identified as seller, the seller remains the contractual supplier; Findit retains its own platform, DSA and product-safety duties.

13. Detailed GPSR distance-offer information

Before a trader's consumer product offer can be published, the interface should capture and display the manufacturer name and postal and electronic address; where the manufacturer is outside the Union, the name and postal and electronic address of the responsible person in the Union; information allowing product identification, including an image, type and other identifier; and warnings or safety information required for the product in a language consumers can understand. Sector-specific rules may require further information.

The seller must provide model, batch, serial or other product identifiers where applicable and must not claim CE marking unless the marking is legally required and correctly supported. Findit may request technical or traceability evidence, check public safety databases, prevent publication, disable recalled or dangerous offers, prevent reappearance and notify purchasers or authorities as required. The Platform's checks do not transfer the economic operator's legal duties to Findit.

14. Promotion and prior-price information

A trader announcing a reduction to Polish consumers must provide the legally required prior-price information. For an ordinary good or service offered for at least 30 days, current Polish rules generally require the lowest price applied during the 30 days before the reduction. Different rules apply to newer offers and rapidly perishable goods. The comparison must appear clearly with the current price wherever the reduction is communicated, including relevant advertising surfaces.
